NexiBot provides Discord bot services for server management, moderation, and entertainment. You agree to use our services in compliance with all applicable laws and regulations, and you will not use NexiBot for any unlawful or prohibited purpose.

4. Premium Services

Certain features of NexiBot are available through a paid subscription ("Premium"). By purchasing a Premium subscription, you agree to the applicable fees and payment terms. We reserve the right to modify subscription fees with prior notice.

For users in the European Union: You have the right to cancel your Premium subscription within 14 days of purchase without giving any reason (cooling-off period). To exercise this right, please contact us via our Support page before the 14-day period expires.

5. Termination

We reserve the right to suspend or terminate your access to NexiBot at our discretion, without notice, for conduct that violates these Terms or is harmful to other users or our services.

6. Limitation of Liability

NexiBot is provided "as is" without warranties of any kind. We are not liable for any damages arising from your use of our services, including but not limited to direct, indirect, incidental, or consequential damages.

For users in the European Union: Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law.

7. Changes to Terms

We may update these Terms from time to time. You will be notified of significant changes, and continued use of NexiBot constitutes acceptance of the updated Terms.

8. Data Protection and Privacy

We collect and process personal data as outlined in our Privacy Policy. By using NexiBot, you consent to such processing.

In compliance with the General Data Protection Regulation (GDPR), users in the European Union have the right to access, rectify, port, and erase their data. They also have the right to object to and restrict certain processing of their data.

9. Governing Law and Jurisdiction

For users in the European Union: You have the right to bring legal proceedings in your local courts. Any disputes may also be addressed through the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/.

For users in the United States: Any dispute arising from these Terms shall be resolved in accordance with the laws of the state in which our company's principal place of business is located.

Regardless of your location, you agree that any dispute shall first be attempted to be resolved through informal negotiation. If a dispute cannot be resolved informally, both parties agree to try in good faith to settle the dispute by mediation before resorting to arbitration, litigation, or other dispute resolution procedure.

10. International Use

Our services are intended for global use. However, we make no representation that materials available through NexiBot are appropriate or available for use in locations outside of the jurisdiction where we operate, and accessing them from territories where their contents are illegal is prohibited. Those who choose to access NexiBot from other locations do so on their own initiative and are responsible for compliance with local laws.
